Among the threats to media freedom around the world is misuse of the ordinary laws of the countries in which the media operate. Chief among these is criminal libel, which is one of the laws most frequently abused to imprison journalists.

MLDI has now made a high-level bid to stop the abuse of this law, at least in the 47 countries signed up to the European Convention on Human Rights. We have formally asked the European Court of Human Rights, which polices the Convention, to lay down clear markers for criminal libel in order to protect journalists.

MLDI and its Russian partner, the Mass Media Defence Centre, have intervened in the case of Orlovskaya Gazeta v. Russia, before the European Court of Human Rights. The case arose from a fine that was imposed on the newspaper, 'Orlovskaya Gazeta', for giving their opinion on a political matter during election times - something that is strictly forbidden under Russian law.

MLDI has provided financial support to Russia's Mass Media Defence Centre in Voronezh to develop a database of Russian media law, along with a guide to media law and the jurisprudence of the European Court of Human Rights. Unique in the country, the database not only provides the text of several hundred media law decisions but also gives commentary and analysis. In addition, the site provides legal templates and a 'how to' guide for less experienced lawyers.
